Terms of Use

1. Purpose
These Terms govern access to and use of the DIAT website and app (the “Service”), published by Kevin Manogarane, sole trader (SIREN 992 960 054). By using the Service, you accept these Terms.
2. Access to the Service
The Service is accessible via the website and the PWA app. Some features require an account and/or a paid subscription. You are responsible for keeping your credentials confidential.
3. User account
You agree to provide accurate information when creating your account and to keep it up to date. You can delete your account at any time from your personal area (GDPR-compliant deletion).
4. Use of the Service
You agree to use the Service in accordance with the law and not to impair its proper functioning. DIAT provides nutritional estimates for informational purposes (see the Medical disclaimer).
5. Intellectual property
All elements of the Service (brand, design, code, content) are protected. Any reproduction without authorization is prohibited. Nutritional data comes from the Ciqual (ANSES) database.
6. Liability
The Service is provided “as is”. DIAT cannot be held liable for decisions made solely on the basis of the information provided. The Service does not constitute medical advice.
7. Subscription, free trial and refunds
In the iOS app, the DIAT Premium subscription is sold and billed by Apple. The monthly subscription is charged as soon as you subscribe. The annual subscription starts with a 3-day free trial: Apple charges the yearly amount within the 24 hours before the trial ends, unless automatic renewal was turned off beforehand. If you cancel the trial before this charge, you are not billed anything and Premium access ends immediately. If you cancel after the charge, you keep access until the end of the paid period and the subscription is not renewed. Refunds for purchases made on the App Store are decided solely by Apple. If you request one, you agree that DIAT may share information about your use of the Service with Apple (account age, share of the subscription already used, amounts paid and refunded) to help it decide. A refunded subscription ends Premium access. In the Android app, the subscription is sold and billed by Google Play, on the same terms. The monthly subscription is charged as soon as you subscribe. The annual subscription starts with a 3-day free trial, at the end of which Google charges the yearly amount unless you cancel beforehand. If you cancel the trial, you are not billed anything and Premium access ends immediately. You can manage or cancel the subscription in Google Play, under Payments & subscriptions. A refund can be requested from Google within 48 hours of purchase, then from DIAT at contact@diat-app.com, which decides. A refunded subscription ends Premium access.
8. Coach space
The Coach space allows a coach with an active coach subscription to follow, in the app, the users who have accepted their invitation (the “clients”): viewing part of their data, appointments, workouts and progress photos, within the limits described in the Privacy Policy. The coach is an independent professional. DIAT provides the tool and is not a party to the relationship between the coach and their clients: services, their prices and their payment are agreed between them and do not go through DIAT. The payment log offered in the app is just a reminder for the coach. The coach agrees to use their clients' data and photos only for coaching them, not to extract or share them, and to take photos only with the consent of the person photographed. Any breach may lead to suspension of the Coach space or of the account. A client can leave their coach at any time, and a coach can end a client's coaching: in both cases, the coach's access to the client's data ends immediately.
9. Termination
You may stop using the Service at any time. DIAT reserves the right to suspend an account in case of breach of these Terms.
10. Governing law
These Terms are governed by French law. In case of dispute, an amicable solution will be sought before any legal action.
